On 05/17/2022 Region 5 filed a Notice to Deny-Refuse Entry for a pesticide containing product. In it Region 5 states that King Technology, failed to properly identify products and file a Notice of Arrival for products prior to importation into the United States. Region 5 states: EPA has made a determination that the quantity of unregistered pesticide, Chlorine Plus contained within this import shipment is unregistered. The quantity of Chlorine Plus failed to meet the requirements set forth under 40 C.F.R. ? 152.30, specifically, the label affixed to Chlorine Plus failed to meet the labeling requirements set forth under 40 C.F.R. ? 156.10 by failing to include, but not limited to, the EPA establishment number of where Chlorine Plus was last produced, name and address of the manufacturer, net contents, directions for use and ingredient statement. The distribution or sale of an unregistered pesticide which fails to meet the requirements set forth under 40 C.F.R. ? 152.30, including the importation of such pesticide, is an unlawful act under Section 12(a)(1)(A) of FIFRA, 7 U.S.C. ? 136j(a)(1)(A). King Technology Inc. failed to submit the NOA for Entry Number 691-02227886 prior to its May 6, 2022, arrival into the United States, as required by Section 17 of FIFRA and 19 C.F.R. ? 12.112(a). Failure by King Technology Inc. to submit an NOA prior to the arrival of unregistered pesticide, Chlorine Plus into the United States, is a violation of Section 12(a)(2)(N) of FIFRA, 7 U.S.C.
