On May 12, 2022, EPA Region 3 entered into a CAFO with CPM Home & Outdoor, LLC to resolve alleged violations of TSCA's Renovation, Repair and Painting Lead Based Paint rules. The violations include failure to obtain firm certification, failure to ensure certified renovators were assigned to the renovation, failure to distribute to property owners a copy of EPA's Renovate Right pamphlet prior to the renovation, failure to post appropriate signage clearly identifying the work area and warning others not involved in the renovation to remain outside of the work area, failure to cover the ground with plastic sheeting or other disposable impermeable material extending 10 feet beyond the perimeter of the surfaces undergoing renovation, and failure to erect vertical containment or equivalent extra precautions in containing the work area to ensure dust and debris from the renovation did not contaminate other buildings or migrate to adjacent properties. The settlement includes a negotiated civil penalty of $1,562.00.
