On June 22, 2022, the Region filed with the Regional Hearing Clerk an expedited settlement agreement entered into with A&E Metal Recycling and Packaging, Inc. of Westport, Massachusetts resolving violations of Section 301 of the Clean Water Act. On November 18, 2021, EPA conducted an inspection of the facility and found that the company was discharging stormwater from outdoor scrap metal stockpiling areas via previously unidentified overland discharge points to two surrounding wetlands. These discharges were not authorized by an individual NPDES permit nor the NPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP). The company promptly obtained MSGP coverage. The settlement requires that the company pay a $15,000 penalty. The Region worked in coordination with the Massachusetts Department of Environmental Protection on this case
