On July 22, 2022, EPA filed a consent agreement and final order settling claims for civil penalties against D and L Realty, LLC and Steven Dolgin, residential property owners, for violating the Toxic Substances Control Act (TSCA) by failing to comply with the Renovation, Repair and Painting Rule (RRP Rule) and the Lead Disclosure Rule. The settlement calls for payment of a $24,199 penalty and compliance with lead paint laws. One of the two properties that are the subject of this enforcement action is known to have had a child with an elevated blood lead level. Based on data obtained from EJ Screen, neither of the two properties is believed to be in a potential EJ area of concern. The State of Vermont Department of Health referred this case to EPA. This settlement will help to prevent children from being exposed to lead-based paint.
