On July 14, 2022, EPA Region 6 issued an Expedited Settlement Agreement (ESA) and Final Order under its authority pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) to Greif USA, LLC, doing business as Delta Chemical Services - Baytown, of Houston, TX. Greif USA was found to be eligible for an ESA based on the company's failure to timely file one or more annual pesticide production reports (Form 3540-16) by the annual March 1 due date. The company agreed to settle the matter and came into compliance by submitting the missing report(s), along with the signed ESA and proof of payment.
