On August 4, EPA issued a CERCLA Administrative Settlement Agreement and Order on Consent to two parties, who will perform a time critical removal action at a property located within the Pierson�s Creek Superfund Site in Newark, Essex County, New Jersey. Respondents have agreed to remove and dispose of three piles of contaminated soil and sediments. Specifically, the actions include maintaining secure tarps on the piles until disposal, sampling the material in the piles to profile the waste streams and determine appropriate disposal facilities, and arranging for disposal. Post-removal soil sampling will be performed to ensure that the soil below and near the piles has not been impacted by the hazardous substances in the piles. The removal action is estimated to cost $750,000 and Respondents have also agreed to pay $47,796 in past response costs and to pay future EPA oversight costs related to the removal action.
