EPA received a complaint from a condominium owner and EPA determined that the realty company may have violated the 1018 Lead Disclosure Rule by failing to ensure that the seller had failed to permit the purchaser a 10-day period to conduct a risk assessment or inspection for the presence of lead-based paint hazards or to obtain the purchaser?s waiver of such opportunity in writing and failed to provide the lessor an EPA-approved lead hazard information/ pamphlet. The Respondent is paying a penalty and has returned to compliance.
