On 8/23/22, EPA Region 6 issued an Expedited Settlement Agreement and Final Order (ESAFO) under its authority pursuant to TSCA to Lail Hamilton Shaw III of Baton Rouge, Louisiana.. The ESAFO was issued in response to violations of:
(1) 40 C.F.R. Part 745.107(a)(I) and Section 409 of TSCA, 15 U.S.C. Section 2689, for failing to provide lessees of five Baton Rouge properties with an EPA-approved lead hazard information pamphlet.
(2) 40 C.F.R. Part 745.113(b)(4) and Section 409 of TSCA, 15 U.S.C. Section 2689, for failing to include in each of the five contracts, a statement by the lessee affirming receipt of the information in 40 C.F.R. Parts 745.113(b)(2) and (b)(3), and the lead hazard information pamphlet.
The ESAFO requires Lail Hamilton Shaw to pay a civil penalty of $2,020.00, in four installments.
