Summary

On August 23, 2022, EPA and Amtrak signed an administrative order on consent (AOC) which continues to ensure that drinking water on Amtrak's passenger railcars will receive protection from bacterial contamination. This is the third version of the AOC with the original signed in 2012 and revised in 2015. Each of Amtrak's passenger railcars with water service is a drinking water system pursuant to the SDWA. The order ensures that Amtrak continues to sample each car on a routine basis for coliform bacteria. In addition, they are required to continue to follow approved procedures for flushing and disinfecting on-board water storage and delivery systems. In the event a sample is positive for E. coli for a car that is in service, Amtrak must notify passengers and crew and also restrict access to the water. Amtrak will report monitoring results to Region III on a quarterly basis. Because Amtrak has its headquarters in Washington, DC, Region III was responsible for negotiating and implementing the order.
