In November 2021, EPA and Respondent agreed to and entered into two Administrative Orders on Consent (Consent Orders) for injunctive relief to mitigate the adverse impacts of the unauthorized work in wetlands adjacent to Cottonwood Lake (CWA-10-2022-0006 ) and Wasilla Lake (CWA-10-2022-0007). EPA alleges that Robert Yundt Homes, LLC failed to comply with the terms of these Consent Orders. EPA estimates over 1 acre of impacts, which includes important salmon rearing habitat along the shoreline of Wasilla Lake. The Consent Decree requires compliance with EPA-approved restoration and mitigation plans, recording of an environmental covenant, three years of monitoring, and a $77,500 civil penalty in addition to the administrative penalties previously collected.
