Summary

On September 16, 2022, Region III entered into a Consent Agreement with, and issued a Final Order to, DC Water (?Respondent?) to settle violations of RCRA Subtitle C. Respondent operates the Blue Plains Advanced Wastewater Treatment Plant, the largest facility of its kind in the world, in the District of Columbia. Respondent engaged a contractor who removed hazardous lead-based paint from heavy machinery and equipment, but then failed to manage the hazardous waste in accordance with RCRA regulations. Among the violations are: operation of a hazardous waste management facility without a permit or interim status, failure to inspect hazardous waste accumulation areas on a weekly basis, and failure to train personnel in proper hazardous waste management. The Consent Agreement and Final Order, which both initiated and resolved the matter, required the Respondent to certify that it is now in compliance and to pay a $173,533 penalty. The Blue Plains facility serves communities of EJ concern. DCDOEE was notified of this action.
