## Summary

On Sept. 26, 2022, EPA Region 1 entered into an Expedited Settlement Agreement (ESA) with Nantucket Ice Company, Inc. (Nantucket, Massachusetts), resolving a violation of Section 312 of the Emergency Planning and Community Right-To-Know Act (EPCRA).  The ESA alleged that Nantucket Ice violated EPCRA Section 312 by failing to submit an emergency and hazardous chemical inventory (Tier II) form for anhydrous ammonia used at its ice-skating complex in Nantucket, Massachusetts.  The ESA requires Nantucket Ice to pay a $5,000 penalty within thirty (30) days of its filing, and it includes a certification that Nantucket Ice has corrected the violations and put procedures in place to ensure its compliance with EPCRA in the future. Massachusetts is not delegated to implement this program, but MA DEP and the Nantucket Fire Department have been notified of this settlement.  According to EPA's EJ Screen application, the Facility is not located in or near areas in which any of the EJ Indices or key demographic variables are at or above the 80th percentile nationally.
