The Highland Fuel Delivery LLC facility is located in White River Junction, VT and off-loads propane from railcars to bulk propane tanks, and then to trucks where the propane is delivered to distributors and residential customers. The Facility's covered processes contains an outdoor propane unloading area where tanker trucks can load propane via hoses connected to a 60,000 gallon bulk propane storage tank, and a rail spur that stores propane in rail cars prior to off-loading into the bulk propane storage tank. EPA inspected the Facility on August 3, 2021, to assess Respondent's compliance with CAA Section 112(r)'s risk management planning (RMP) regulations and the Emergency Planning and Community Right-to-Know Act. EPA identified violations that included: a late RMP re-submission, a late Process Hazard Analysis update, and a late Off-Site Consequence Analysis update. On September 27, 2022, EPA and the company entered into an expedited settlement agreement for $5,700 to resolve these violations. EPA directly implements the RMP regulations but has notified the State of this matter.
