EPA alleged that Respondent violated RCRA tank and air emission requirements. Respondent contended that its tanks were exempt from regulation under the manufacturing process unit exemption at 40 CFR 261.4(c). Both parties filed motions for accelerated decision on liability. The ALJ granted Respondent's motion for accelerated decision and denied EPA's motion for accelerated decision.
