On October 3, 2022 (Date payment processed by CFC), EPA Region III settled Clean Air Act (CAA) matter with United States Cold Storage LLC for the United States Cold Storage Quakertown facility located in Quakertown, Pennsylvania. After a Risk Management Program inspection by the Oil and Prevention Enforcement Section on October 26, 2021, EPA found that the Respondent had violated regulations implementing Section 112(r) of the CAA which requires chemical accident prevention planning at facilities that use certain hazardous substances. EPA found that the Respondent had violated regulations implementing Section 112(r) of the Act, specifically for failing to document that equipment complies with recognized and generally accepted good engineering practices with respect to the following. The facility installed a relief header for Compressor #3 that was approximately 14 feet horizontally from a roof air intake for the ammonia refrigeration machinery room. There was also a king valve present at the time of inspection located 11.5 feet above the floor which did not have a chainwheel for safe operation in an emergency. United States Cold Storage has agreed to pay a cash penalty of $1,500 as part of an Expedited Settlement Agreement and Final Order.
