On March 1, 2022, EPA issued to Smith Creek an Expedited Settlement Agreement Notice Letter for the failure to submit a complete 2019 Report and the failure to submit the 2020 Report by the March 1st deadline. That same day, Smith Creek submitted the 2019, 2020, and 2021 Reports electronically to EPA. The 2019, 2020, and 2021 Reports were accompanied by an establishment termination request for EPA Est. No. 93318-IN-1.
Therefore, EPA terminated the establishment registration for EPA Est. No. 93318-IN-1 located at 8991 Louis Smith Road, Borden, Indiana 47106 and has instead elected to issue to Smith Creek this Notice of Warning, pursuant to Section 14(a)(4) of FIFRA, 7 U.S.C. ? 136l(a)(4).
