Summary

Region 5 filed a Consent Agreement and Final Order (CAFO) commencing and concluding an action against City, Water, Light and Power (CWLP) of Springfield, Illinois. EPA alleges that CWLP violated the National Emission Standards for Hazardous Air Pollutants for Coal- and Oil-Fired Electric Utility Steam Generating Units at 40 C.F.R. Part 63, Subpart UUUUU. CWLP operated four coal-fired boilers (two have been shut down since EPA issued the Finding of Violation in 2019) at the Dallman Station, which are subject to Subpart UUUUU. Emissions were continuously monitored for mercury emissions with sorbent trap monitoring systems. CWLP reported downtime of the continuous mercury monitoring systems for each boiler as a percent of total operating time for the semi-annual reporting period. The percent downtime ranged from 1.9 to 25 for reporting periods from January 2016 to December 2018. CWLP has demonstrated that it now qualifies as a Low Emitting Electric Generating Unit. As such, the continuous monitoring of mercury is no longer required. CWLP has agreed to pay a civil penalty of $14,600 and spend $45,000 on a mitigation action to replace 150 mercury vapor streetlights with LED lights. Dallman Station is located in an area with environmental justice concerns. The State of Illinois was notified of the Finding of Violation and did not object to EPA enforcement.
