On November 7, 2022, EPA filed an expedited settlement agreement with Minichiello Brothers, Inc. of Worcester, Massachusetts resolving violations of Section 301 of the Clean Water Act. An EPA inspection of the facility, which operates a scrap metal and recycling business, revealed that the company was discharging stormwater from point sources at the site. These discharges were not authorized by an individual NPDES permit nor the NPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP). The company promptly worked to eliminate all stormwater discharges from the site. The settlement requires that the company pay a $5,000 penalty. The facility is located in an area impacted by Environmental Justice issues. The Region worked in coordination with the Massachusetts Department of Environmental Protection on this case.
