On 10/31/22, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) to Daycor Enterprises Inc. of Melissa, TX., regarding alleged violations of the Toxic Substances Control Act (TSCA). The alleged violations involve Section 409 of TSCA, 15 U.S.C. ? 2689 (under Title IV -Lead Exposure Reduction), by failing to comply with the regulatory requirements of 40 C.F.R. Part 745, Subpart E, and are as follows:
Count 1 - Failure to obtain firm certification before performing a renovation at a property.
Count 2 - Failure to assign a certified renovator to the property.
Count 3 - Failure to provide the owner of the property with the required EPA pamphlet on lead hazard information.
Count 4 - Failure to prepare and retain records.
The Respondent will pay a civil penalty of $11,017 within thirty days of the issuing of the CAFO.
