On November 14, 2022, EPA Region 1 entered into a combined Complaint and Consent Agreement and Final Order (CAFO) with the Town of Southington, Connecticut, to resolve EPA's claim that the Town violated the Toxic Substances Control Act by continuing to use polychlorinated bi-phenyls (PCBs) in vapor barriers and mastic at two middle schools: the Joseph A. DePaulo and John F. Kennedy Middle Schools. The PCBs are located between the walls, and years of monitoring results indicate that they are not posing a risk. The CAFO imposes a 20-year schedule for monitoring the PCBs and ultimately disposing of them. EPA Headquarters has approved the CAFO. The TSCA PCB regulations are directly implemented by EPA, and according to EJ Screen, neither school is in an area of Environmental Justice concern.
