On May 11, 2022, EPA Region 3 issued a Notice of Potential Violation and Opportunity to Confer letter to Chemalloy Company, LLC, an industrial facility that manufactures custom sized alloys, metals, minerals, and chemicals (the Facility ) in Conshohocken, Pennsylvania. On September 29, 2021, EPA conducted an inspection of the Facility and found alleged violations that include failure to update preparedness, prevention, and contingency plan, failure to conduct training, failure to implement proper operation and maintenance measures, failure to implement pollution prevention and exposure minimization measures, failure to implement spill prevention and response measures, failure to ensure good housekeeping, failure to conduct routine inspections, and failure to submit annual reports. EPA routinely inspects industrial facilities to examine their compliance with their stormwater NPDES permits to further the goals of the program. The Facility has been invited to discuss these allegations with EPA to obtain resolution without the necessity of a hearing. The Facility is in an area of EJ concern. None of the primary EJ Indexes are at-or-above the 80th percentile in the nation or in the state for the area, however, several environmental indicators of potential exposure are at-or-above the 80th and even 90th percentiles in the nation and/or the state.
