the device is not labeled in accordance with FIFRA ? 2(q)(1) in that the product label appears
to include claims that are false or misleading in relation to the efficacy of the product such as
unqualified claims against ?germs? and claims that the product ?traps more harmful particles
than leading competitors.? Additionally, model MA-40 does not appear to be labeled with
