On November 15, 2022, EPA and Precise Packaging, LLC (Precise Packaging) settled an administrative penalty case for alleged violations of the Resource Conservation and Recovery Act (RCRA) and the Massachusetts hazardous waste regulations codified at 310 C.M.R. 30.001, et seq. Precise Packaging operated as a large quantity generator between May 10, 2019 and July 12, 2021 but failed to re-notify as a large quantity generator. Precise Packaging also failed to comply with numerous conditions triggered by the facility's large quantity generator status, such as provision of initial and refresher training for employees, maintenance of a chemical release contingency plan, and performance of weekly inspections, which were necessary for the facility to qualify for an exemption from RCRA's permitting requirement. Precise Packaging agreed to pay a settlement penalty of $43,877 and to perform a Supplemental Environmental Project that will cost approximately $57,114. Precise Packaging also certified that it corrected its violations and will maintain compliance with federal and state hazardous waste laws.
