A referral package for civil litigation that we are requesting to be initiated against Mr. Robert White (White), of Elizabeth City, North Carolina for violating section 301(a) of the Clean Water Act (the ?CWA?), 33 U.S.C. ? 1311(a).
This referral seeks the Department of Justice?s (DOJ) help in securing the restoration of approximately 11.87 acres of wetlands. Additionally, the U.S. Environmental Protection Agency (EPA) is seeking the DOJ?s help in securing civil penalties for significant unpermitted discharges into waters of the United States.
White discharged dredged and/or fill material without a CWA section 404 permit into waters of the United States through extensive bulkhead construction and backfilling of the wetlands behind the bulkheads. White impacted aquatic resources during the construction of these bulkheads at three parcels he owns. The parcels are adjacent to the Albemarle Sound and the bulkhead construction created level, open water areas suitable for dock construction.
