NOVEMBER 30, 2022 - NOTICE OF REFUSAL OF ADMISSION
FIFRA 12(a)(1)(F): To sell or distribute a pesticide device that is misbranded. The device is
not labeled in accordance with FIFRA ? 2(q)(1) in that it contains claims considered false or
misleading. Specifically, the product manual states the device can be used to control germs,
but does not qualify the claim with the microorganisms encompassed by the term and which
were used in testing the efficacy of the product. The claim appears misleading because it
implies the product is effective against all pathogenic microorganisms that fit within the
general term germs.
