On December 12, 2022, EPA Region III entered into a Consent Agreement and Final Order with Outdoor Trading, LLC ( Respondent ) alleging violations of FIFRA and implementing Pesticide Program regulations promulgated at 40 C.F.R. Parts 150 -189, Subchapter E, in connection with the distribution and/or sale of the unregistered pesticides ULV 500, the Ultimate Cleaning Kit, and Neem Oil. This enforcement action furthers FIFRA's purpose of promoting environmentally safe and effective pesticide use and prevents the potentially harmful use of pesticides. On September 28, 2020, EPA became aware of Respondent offering for sale its ULV 500, the Ultimate Cleaning Kit and Neem Oil products with alleged pesticidal claims on the Petra Tools Website and on November 19, 2020, EPA issued Respondent an Advisory Letter. Respondent removed some of the alleged claims from its website, however, EPA identified additional pesticidal claims made for its products. EPA issued Respondent a Notice of Potential Violation and Opportunity to Confer ( NOPVOC ) on February 3, 2022. The Consent Agreement alleges that Outdoor Trading, LLC violated FIFRA and EPA's Pesticide Program regulations by selling ULV 500, the Ultimate Cleaning Kit, and Neem Oil with pesticidal claims, without the products being registered under FIFRA .
