On December 14, 2022, EPA Region 6 issued a Consent Agreement and Final Order 'CAFO' under its authority pursuant to Resource Conservation and Recovery Act to WWF Operating Company, LLC located in Dallas, Texas. The CAFO was issued in response to violations of: 1) Failure to file an adequate or accurate initial or subsequent notification and 2) Failure to meet the requirements of a Small Quantity Generator. The compliance section of the CAFO requires WWF Operating Company, LLC to (1) certify that it has assessed all its solid waste streams at the WWF Facility to determine accurate waste management and operation of the WWF Facility in compliance with RCRA and the regulations promulgated thereunder; (2) certify that it has accurately and adequately complied with its RCRA Section 3010 notification for the WWF Facility. WWF Operating Company, LLC must respond to EPA Region 6 by 60 days from the effective date of the CAFO.
