Summary

On December 15, 2022, EPA filed a Consent Agreement and Final Order both initiating and resolving an action against IDK Ventures, Inc. dba CertaPro Painters of Maine (CertaPro) for alleged violations of the Toxic Substances Control Act (TSCA) and the Renovation, Repair and Painting Rule (RRP Rule). CertaPro, a franchise based in Westbrook, Maine, provides residential and commercial painting services, mostly hiring subcontractors to perform the work. EPA alleged that CertaPro failed to: (1) ensure that all individuals performing renovation activities on behalf of the firm are either certified renovators or have been trained by a certified renovator, and ensure that a certified renovator is assigned to each renovation performed by the firm and discharges all of the certified renovator responsibilities identified in 40 C.F.R. S 745.90; (2) provide the owner of each target housing unit where work was to be performed with the Renovate Right pamphlet; (3) ensure that, before beginning the renovation, the ground is covered with plastic sheeting or other disposable impermeable material extending 10 feet beyond the perimeter of surfaces undergoing renovation; and (4) ensure that the all ducts in the work area are covered with taped-down plastic sheeting or other impermeable material. CertaPro will pay a $16,636 penalty and come into compliance the RRP Rule. One of the properties at which a violation occurred is located in an area of Environmental Justice concern.
