Summary

On January 18, 2023, EPA Region III entered into a Consent Agreement and Final Order with RJT Industries, Inc. resolving allegations that it had violated the Renovation, Repair and Painting Lead Based Paint rules (RRP) under 40 C.F.R. Part 745, Subpart E, in connection with the renovation of a residential property in Arlington, VA. A March 23, 2022 Site Inspection and May 11, 2022 Records Inspection revealed that at the time renovation work was being performed, RJT Industries, Inc. (1) failed to provide the owner of the property a Renovate Right pamphlet prior to renovations in violation of 40 C.F.R. 745.84(a)(1); (2) failed to provide an adult occupant a Renovate Right pamphlet prior to renovations in violation of 40 C.F.R. 745.84(a)(2); (3) failed to close all doors and windows within 20 feet of the renovation in violation of 40 C.F.R. 745.85(a)(2)(ii)(A); (4) failed to contain waste from renovation activities to prevent releases of dust and debris before the waste is removed from the work area for storage or disposal in violation of 40 C.F.R. 745.85(a)(4)(i); and (5) failed to retain and make available to the EPA the required documentation under 40 C.F.R. 745.86(b)(6) for the renovations conducted in violation of 40 C.F.R. 745.86(a). These TSCA requirements protect public health and the environment by protecting occupants of potential lead risks in residential properties. The property at issue was not in an EJ Area of Concern.
