On March 1, 2023, Region 10 filed an expedited settlement agreement resolving violations of the Clean Water Act by OBI Seafoods, LLC located in Kodiak, Alaska. Respondent operates a bulk fuel storage tank farm and fueling dock at the OBI Seafoods, LLC facility in Kodiak, Alaska. An EPA spill prevention, control and countermeasure (SPCC) inspection on May 24, 2022 determined the OBI's SPCC Plan for the tank farm lacked protocols for and records of prescribed formal tank integrity inspections and testing for the fuel oil #2 aboveground double-walled tanks.  The facility, located within 200 feet of Women's Bay, has oil storage capacity exceeds 5,040 gallons including two tanks, oil filled equipment and 12 drums of lube and hydraulic oils0.  The OBI Seafoods, LLC facility is located on the northwest side of Kodiak Island's Chiniak Bay within the Gulf of Alaska.  Commercially various salmon species, King crab, pollock, cod, and other species are harvested by both local and non-resident fishermen and processed in local facilities. Kodiak is the home harbor for hundreds of fishing fleets. OBI Seafoods, LLC agreed to modify it's SPCC Plan to identify a specific integrity testing standard for the facility's tank farm, implement integrity testing per the standard, and pay a penalty of $469 for the SPCC regulatory violations.
