On 1/13/23, the Environmental Protection Agency (EPA), Region 6, issued a Formal Notice of Warning under its authority pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) to Rockwater Energy Solutions of Houston, TX. The EPA alleges that Rockwater Energy Solutions violated Section 12(a)(2)(L) of FIFRA, 7 U.S.C. Section 136j(a)(2)(L), by failing to submit pesticide production reports for the 2021 calendar year for one facility in Oklahoma and two facilities in Texas by the due date of 3/1/22. Repeat violations could subject Rockwater Energy Solutions to a civil administrative penalty, or other actions.
