On December 22, 2022, Region 3 issued 26 Notices of Warning (NOW) for Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) violations at EPA-Registered Pesticide Producer Establishments throughout Region 3. Each establishment was cited for failure to submit their 2021 annual pesticide production report on or before the March 1, 2022 deadline or failure to submit their initial report within 30 days of registering, as required. Every March 1st, and within 30 days of registering with EPA, these establishments are required to submit their production reports to EPA, listing the names and types of pesticides they produce, the amounts produced and distributed in the previous year, and the amount they expect to produce in the coming year. The facilities include: 3 Delaware, 4 Maryland, 14 Pennsylvania, and 5 West Virginia Producer Establishments. The respective Departments of Agriculture were notified of these actions. Some of the 26 facilities are in areas of potential EJ concern.
