On January 24, 2023, EPA entered into an Expedited Settlement Agreement (ESA) with Theranostix, Inc. for violations of RCRA Subtitle C (Hazardous Waste Program). Theranostix is a diagnostic reference lab that prepares biopsy slides from human tissue that will eventually be reviewed by pathologists for diagnosis of a patient's conditions. The compliance issues addressed in the ESA involve operating a hazardous waste storage facility without a permit or valid exemption to the permitting requirements by failing to mark a container of hazardous waste with the date upon which accumulation first began, failure to describe in its Contingency Plan arrangements with local authorities and list the emergency equipment and the locations at the Facility, and failure to implement a hazardous waste training program for its employees. Theranostix also failed to submit a 2019 Biennial Report to EPA by March 1, 2020. The company has agreed to pay a civil penalty of $6,250 and has corrected the violations cited in the ESA.
