On 1/19/23, the Environmental Protection Agency (EPA), Region 6, issued a Formal Notice of Warning under its authority pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) to Independence Oilfield Chemicals LLC of The Woodlands, TX. The EPA alleges that Independence Oilfield Chemicals violated Section 12(a)(2)(L) of FIFRA, 7 U.S.C. Section 136j(a)(2)(L), by failing to submit pesticide production reports for the 2021 calendar year by the due date of 3/1/22 for three of its facilities in Midland, Pecos, and Pleasanton, TX. Repeat violations could subject Independence Oilfield Chemicals to a civil administrative penalty, or other actions.
