On January 31, 2023, the Regional Judicial Officer approved an expedited settlement agreement with Excel Recycling, LLC of Westport, Massachusetts resolving violations of Section 301 of the Clean Water Act. On October 28, 2021, the Region conducted an inspection of the facility and found that the company was discharging stormwater from point sources at the site. These discharges were not authorized by an individual NPDES permit nor the NPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP). The company promptly worked towards obtaining MSGP coverage. The settlement requires that the company pay a $6,000 penalty. The Region worked in coordination with the Massachusetts Department of Environmental Protection on this case.
