On March 2, 2023, the thirty- (30) day public comment period concluded and EPA did not receive any comments for the Site Settlement Agreement. EPA has determined the Agreement is effective and the Effective Date is March 3, 2023. Payment by Philips for Past Response Costs under the Settlement Agreement is due within 30 days after the Effective Date in the amount of $706,175.90.
On January 31, 2023, EPA published notice in the Federal Register which initiated a required 30-day public comment period for the proposed settlement. The agreement calls for payment of $706,175.90, plus interest calculated from the Effective Date through the date of payment. The Effective Date is the date upon which EPA issues written notice to Philips that the public comment period has closed with no comments received necessitating withdrawal or modification. As the comment period closes COB March 2, I anticipate the Effective Date will be March 3, 2023.
