Summary

On August 16, 2023, Region 10 filed an expedited settlement agreement resolving violations of the Clean Water Act by Kodiak Fishmeal Company (KFC) located in Kodiak, Alaska. Respondent operates a bulk fuel storage tank farm at the KFC facility in Kodiak, Alaska. An EPA spill prevention, control and countermeasure (SPCC) inspection on May 25, 2022 determined KFC lacked adequate secondary containment for two aboveground single-walled tanks. Additionally, KFC?s SPCC Plan for the tank farm lacked protocols for and records of tank integrity inspections and testing for six fuel oil #2 and fish oil aboveground double- and single-walled tanks. The tank farm's fuel tanks have storage capacity of approximately 83,000 gallons and are located within 200 feet of Women's Bay. The KFC facility is located on Women's Bay which is located on the northwest side of Kodiak Island's Chiniak Bay within the Gulf of Alaska. Commercially various salmon species, King crab, pollock, cod, and other species are harvested by both local and non-resident fishermen and processed in local facilities. Kodiak is the home harbor for hundreds of fishing fleets. KFC agreed to develop secondary containment for the two aboveground single-walled storage tanks and implement integrity testing protocols within its SPCC Plan for the facility's tank farm and pay a penalty of $1,719 for the SPCC regulatory violations.
