On February 7, 2023, EPA Region III entered into a Consent Agreement and Final Order with I360 Rentals resolving allegations that the firm had violated the Lead Disclosure Rule under 40 C.F.R. Part 745, Subpart F, in connection with the lease of 9 residential properties in Chambersburg, Pennsylvania. A September 29, 2021 Inspection revealed that, I360 Rentals (1) failed to timely include, as an attachment or within the contract to lease target housing, the Lead Warning Statement as required by 40 C.F.R. 745.113(b)(1); and (2) failed to include, as an attachment or within the contract to lease target housing, a statement by the lessor disclosing the presence of known lead-based paint and/or lead-based paint hazards as required by 40 C.F.R. 745.113(b)(2). These TSCA requirements protect housing tenants from potential lead-based paint risks in rental properties. One property at issue is located in an EJ area of concern. TSCA enforcement is not a state-delegated program; the Pennsylvania Department of Environmental Protection was notified of this action. Under the Consent Agreement and Final Order, I360 Rentals will pay a civil penalty in the amount of $32,085 over the course of a two-year payment plan to settle the alleged violations.
