On February 7, 2023, Region 2 entered into Administrative Order and Settlement Agreement and Order on Consent for a Removal Action, Index No. CERCLA-02-2023-2002 (Settlement Agreement), under CERCLA with Respondent, for the upgrade of an aging bulkhead and treatment of separated stormwater at the Gowanus Canal Superfund Site in Brooklyn, New York. This is one in a series of new bulkheads needed to provide structural support for the dredging and capping of the Canal, which began in November 2020 and is ongoing. The Settlement Agreement also requires the Respondent to operate and maintain a treatment unit for separated stormwater discharging from the property into the Canal. The work under the Settlement Agreement is valued at $6,000,000.
