On December 8, 2022, EPA Region III served an Administrative Complaint and Notice of Opportunity for Hearing on Mr. Robert Lauter d/b/a Prime Cut Paint for alleged violations of TSCA's Renovation, Repair and Painting Lead Based Paint rules. Mr. Lauter operates out of Norfolk, Virginia and the alleged violations occurred at four different Target Housing properties located in the Tidewater region of Virginia. According to EJSCREEN, the area impacted by the violations may include potential environmental justice communities of concern . The violations include failure to obtain firm certification, failure to ensure certified renovators were assigned to the renovation, failure to distribute to property owners a copy of EPA's Renovate Right pamphlet prior to the renovation, failure to make available all records demonstrating performance of all lead-safe work practices, failure to post appropriate signage clearly identifying the work area and warning others not involved in the renovation to remain outside of the work area, and failure to cover the ground with plastic sheeting or other disposable impermeable material extending 10 feet beyond the perimeter of the surfaces undergoing renovation. The complaint proposes a penalty of $117,250.
