On 1/25/23, the Environmental Protection Agency (EPA), Region 6, issued a Formal Notice of Warning under its authority pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) to White Sands Energy Solutions LLC of Alamogordo, NM. The EPA alleges that White Sands Energy Solutions violated Section 12(a)(2)(L) of FIFRA, 7 U.S.C. Section 136j(a)(2)(L), by failing to submit pesticide production reports for the 2020 and 2021 calendar years by the respective due dates of 3/1/21 and 3/1/22. Repeat violations could subject White Sands Energy Solutions to a civil administrative penalty, or other actions.
