Summary

On February 16, 2023, EPA Region III issued an Administrative Compliance Order on Consent (Order) to Spray Products Corporation, the owner and operator of a manufacturing and packaging facility for aerosol products and liquids, located in Plymouth Meeting, Montgomery County, Pennsylvania. EPA alleges that Spray Products failed to safety store flammable gases and liquids and maintain process equipment at the facility in accordance with CAA Section 112(r)(7) and regulations, the Chemical Accident Prevention Provisions. Further, Spray Products failed to safely design and maintain the facility for its flammable chemicals in accordance with the General Duty Clause of CAA Section 112(r)(1). Under the Order, the company will retain a third-party contractor to assess the Facility?s compliance with the Risk Management Program and the General Duty Clause and conduct any necessary improvements to ensure compliance. The facility is located in an area of potential EJ concern, with 9 of 12 State Primary EJ indexes and 3 of 12 Nation Primary EJ indexes at or above the 80th percentile, and 5 of 7 socioeconomic indicators exceeding the state average. This case seeks to ensure that facilities that store extremely hazardous substances safely store their chemicals to reduce the likelihood of accidental chemical releases and the resulting potential harm to neighboring communities and the environment, which is especially important in potential EJ areas.
