This Administrative Consent Order (ACO) for Allied Recycling, Inc., Arcadia, Florida addresses violations of the Protection of Stratospheric Ozone regulations found at 40 C.F.R. Part 82, Subpart F. Allied Recycling, Inc. failed to reduce emissions of ozone depleting substances and their substitutes. Specifically, Allied failed to recover refrigerants or verify that refrigerants were properly recovered from small appliances and motor vehicle air conditioners (MVACs) that it accepted for recycling at its facility in Arcadia, Florida. We discovered these violations through an inspection of the facility on March 5, 2019.
This ACO requires Allied or its assignee or successor to purchase refrigerant recovery equipment for small appliances. It also requires Allied or its assignee or successor to use a verification statement to verify proper recovery of small appliances and MVACs when accepting such appliances containing no refrigerant during one-off transactions. Commercial suppliers are required to have contracts with the scrap yard to ensure proper recovery without the use of the one-off verification statements. Allied or its assignee or successor is required to update all signage to state what is acceptable material and develop robust training for the refrigerant recovery procedures. The ACO addresses the violations set forth in the FOV issued to Allied on March 23, 2021, and again on April 29, 2021, when the first sending elicited no response from the company.
