Summary

On February 24, 2023, Region 3 entered a Consent Agreement and Final Order with E.G.E. Corporation, doing business as Red Top Kenilworth Gas Station, for RCRA underground storage tank (UST) management violations. The respondent is a retailer of petroleum products in Kenilworth, MD. The violations involved failure to provide piping release detection on three (3) USTs and failure to provide annual line leak detector (LLD) testing on three (3) LLDs for significant periods of time at the retail facility. Such violations can potentially lead to petroleum product leaks which can be harmful to both human health and the environment. The Maryland Department of the Environment was provided notice of the planned enforcement action and had no objections. The settlement required the respondent to certify that it is now in compliance with applicable UST requirements, and to pay a $43,433 penalty. The facility is located in an area of potential EJ concern.
