The U.S. Environmental Protection Agency, Region 9 (R9), issued a Complaint against Eric Hauck, individually and as trustee for the Acton Holding Trust, for violating EPA's 2005 ban on Large Capacity Cesspools (LCCs). The ban was enacted under the Safe Drinking Water Act Underground Injection Control regulations. R9 found the Respondent utilizing two LCCs for sanitary wastewater disposal at Cactus Creek Mobile Home Park, Acton, CA. The Complaint was filed due to Respondents unwillingness to engage local, state and federal agencies on any matters. The Complaint requires the Respondent to close the LCCs within 60 days of any Final Order and R9 will pursue a civil penalty of up to the statutory maximum of $337,725. On 7/27/2023, R9 moves for the entry of a Motion of a Partial Default on Liability. This motion is made pursuant to 40 C.F.R. Section 22.17. Complainant requests a ruling that all allegations in the Complaint are deemed admitted by Respondent, Eric Hauck, and that, as a consequence, Respondent is liable for the violations as set forth in the Complaint.
