On February 16, 2023, EPA filed a consent agreement and final order both initiating and settling claims for civil penalties against Nylo Metal Finishing, LLC (Nylo) for violating the Resource Conservation and Recovery Act (RCRA) and Connecticut's hazardous waste regulations. Nylo failed to notify the Connecticut Department of Energy and Environmental Protection (CT DEEP) that it had become a large quantity generator of hazardous waste at the facility, create and maintain records of an annual employee training program regarding hazardous waste management procedures, maintain a complete contingency plan designed to prevent and to minimize hazards to public health, safety, or welfare or the environment, file Biennial Reports, and maintain records of weekly inspections of hazardous waste containers. The company will pay a penalty of $20,000. The Nylo facility is located in an area of environmental justice concern. The settlement will help to protect nearby residents and facility employees from the risks associated with a release of hazardous waste.
