Region 5 filed a Consent Agreement and Final Order (CAFO) commencing and concluding an administrative action against Global Xpress Parts LLC (GXP) of Elwood, Indiana, and Extra Power Performance LLC (EPP) of Carmel, Indiana. EPA alleged that between January 2018 and January 2021, GXP sold 6,540 parts and/or components that bypass, defeat, or render inoperative emission controls and emission-related elements of design on motor vehicles (defeat devices), in violation of Section 203(a)(3)(B) of the Clean Air Act (CAA), 42 U.S.C. � 7522(a)(3)(B). EPA also alleged that between January 2018 and May 2021, EPP sold 411 defeat devices in violation of Section 203(a)(3)(B) of the CAA.
Under the CAFO, GXP and EPP will pay a $552,590 penalty and have agreed to cease all tampering and manufacturing or sale of defeat devices. In addition, GXP and EPP have certified that they are fully complying with Section 203(a)(3)(A) and (B) of the CAA. Since GXP and EPP sold defeat devices throughout the U.S., it was not possible to assess the environmental justice impacts of this settlement.
