FIFRA ? 12(a)(1)(A): To sell or distribute to any person any pesticide that is not registered under Section 3 or whose registration has been cancelled or suspended, except to the extent that distribution or sale otherwise has been authorized by the Administrator under FIFRA. Specifically, the unregistered pesticide product is not labeled in compliance with 40 C.F.R for ? 156.10 and therefore does not qualify as a pesticide that may be transferred, sold, or distributed without registration under 40 C.F.R. ? 152.30(c)(2).
