## Summary

On November 3, 2022 the EPA entered into an Administrative Order on Consent (AOC) with City of Northglenn, Colorado to resolve the City?s failure to implement and enforce its pretreatment Program. The AOC provides specific timelines for the City to return to compliance with pretreatment requirements in its National Pollutant Discharge Elimination System (NPDES) permit issued by the Colorado Department of Public Health and Environment (CDPHE), effective January 1, 2020. The City failed to meet the following NPDES permit requirements cited in the order: develop and revise specific local limits or demonstrate that they are unnecessary; operate pursuant to enforceable legal authority (i.e., an ordinance); include all required elements in Significant Industrial User (SIU) permits the City issues; identify and characterize IU contributions; conduct annual compliance monitoring; report and implement sufficient investigation and sampling procedures; evaluate whether SIUs need a slug discharge control plan and ensure that plan meets the regulatory requirements; accurately report data in annual reports; and ensure sufficient resources to implement the pretreatment program. The EPA has provided and continues to provide compliance assistance to the City as it works to return to compliance. The EPA directly implements the pretreatment requirements of the NPDES program in Colorado.
