On March 7, 2023, EPA filed an expedited settlement agreement (Agreement) entered into with American GreenFuels, LLC of New Haven, Connecticut, addressing violations of the Oil Pollution Prevention regulations, promulgated under Section 311(j) of the Clean Water Act. An EPA Spill Prevention Control and Countermeasure (SPCC) inspection at the company's facility revealed that the company did not have an adequate SPCC plan. Following the inspection, American GreenFuels provided EPA with an amended SPCC plan, resolving the SPCC violations. Pursuant to the Agreement, American GreenFuels, LLC will pay a $9,623 penalty. The SPCC Program is a direct implementation program. However, the Region shares copies of all expedited settlements with the State and Coast Guard. The facility is located in an area where the community faces environmental justice issues.
